Terms of Service

These Terms of Service ('Terms') govern your access to and use of M.E. Synthesis (the 'Service'), operated by J.M. Reid ('we', 'us', or 'our'). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum digital age of consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement.

2. License to use the Service

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own non-commercial enjoyment and experimentation. All rights not expressly granted are reserved.

3. Intellectual property

The Service, including its source code, audio engine, user interface, graphics, text, logos, the name "M.E. Synthesis", and all related branding, is owned by J.M. Reid and is protected by copyright, trademark, and other applicable laws. References to third-party trademarks (such as Moog® or Buchla®) are made solely for descriptive purposes; no affiliation or endorsement is implied.

Audio output you create using the Service belongs to you. We claim no ownership over recordings or compositions you produce.

4. Acceptable use

You agree not to:

  • Use the Service to violate any law or the rights of others.
  • Attempt to interfere with, disrupt, overload, or reverse engineer the Service or any underlying infrastructure.
  • Use automated means (bots, scrapers, etc.) to access the Service in a way that imposes an unreasonable load.
  • Resell, sublicense, or commercially exploit the Service without our prior written consent.
  • Use the Service to harass, harm, or impersonate any person or entity.

5. Hearing safety

The Service produces sound and can become loud quickly. You are responsible for setting safe playback levels and for taking appropriate precautions when using headphones or speakers. See our Disclaimer for more.

6. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, secure, error-free, or free from harmful components, or that any defects will be corrected.

7. Limitation of liability

To the maximum extent permitted by law, in no event will J.M. Reid or any contributors to the Service be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, hearing, or equipment, arising out of or in connection with your use of (or inability to use) the Service, even if advised of the possibility of such damages.

Our total aggregate liability for all claims relating to the Service will not exceed one hundred U.S. dollars (USD $100).

8. Indemnification

You agree to defend, indemnify, and hold harmless J.M. Reid and any contributors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Service or your violation of these Terms.

9. Modifications to the Service and Terms

We may modify, suspend, or discontinue the Service (or any part of it) at any time without notice. We may also revise these Terms from time to time; the "Last updated" date at the top of this page reflects the most recent version. Continued use of the Service after a change constitutes acceptance of the revised Terms.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice. Sections of these Terms that by their nature should survive termination will survive (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law).

11. Governing law and venue

These Terms are governed by the laws of the United States and the state in which J.M. Reid resides, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in that state, and you consent to personal jurisdiction there. Where required by law, this clause does not deprive you of any consumer protection you are entitled to in your jurisdiction of residence.

12. Severability and entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and us regarding the Service.
